New York Pepper Spray Laws & POM Shipping Update

POM is proudly based in New York, which makes this issue especially meaningful to us. While POM Pepper Spray is available to customers across much of the country, current New York State law still prevents us from shipping pepper spray directly to customers in our own home state.

Recent New York legislation has advanced that could modernize the way lawful self-defense spray devices are sold in the state. If signed into law and implemented, these changes may eventually allow eligible New York residents to purchase approved self-defense spray products online and have them shipped within New York.

Current Status:

POM Pepper Spray cannot currently be shipped directly to New York State addresses. Although proposed legislation has passed both houses of the New York State Legislature, it has not yet changed the current shipping restrictions.

Why Can’t POM Ship Pepper Spray to New York Right Now?

New York allows eligible adults to possess qualifying self-defense spray devices, but the state places strict limits on how those products may be sold. Under current law, sales are limited to licensed firearms dealers, licensed pharmacists, or another vendor authorized and approved by the Superintendent of State Police.

For New York customers, this means pepper spray access is more limited than it is in many other states. Instead of ordering online for direct shipment, New York residents generally need to purchase qualifying self-defense spray devices through an approved in-state seller.

New York Pepper Spray Bill Update: A1838C / S4922C

New York lawmakers have advanced legislation related to the sale and possession of self-defense spray devices. The current legislative effort is reflected in Assembly Bill A1838C and its Senate counterpart, S4922C.

If enacted, this legislation would remove the requirement that only licensed firearms dealers, licensed pharmacists, or specially authorized vendors may sell self-defense spray devices. It would also allow the sale and shipping of approved self-defense spray devices within New York State, subject to the final text of the law and any applicable regulatory guidance.

Important:

This legislation has passed both the New York State Senate and Assembly, but it has not yet become law. Until New York law officially changes, POM must continue following the current restrictions and cannot ship pepper spray directly to New York State customers.

What This Could Mean for POM Customers in New York

For POM, this potential change is personal. We are a New York-based company, and it is especially meaningful to see legislation advance that could make it easier for responsible New York residents to access lawful self-defense spray products.

If the legislation becomes law and POM is legally permitted to ship compliant products into New York, eligible New York residents may eventually be able to order approved pepper spray products online and have them shipped directly within the state.

For POM customers, this could mean easier access to modern everyday carry pepper spray options similar to what customers in many other states can already purchase online.

Can I Buy POM Pepper Spray in New York Right Now?

At this time, POM Pepper Spray is not available for direct shipment to New York State addresses.

Under current law, New York residents must purchase qualifying self-defense spray devices in person from a licensed firearms dealer, licensed pharmacist, or another authorized vendor.

Who Can Legally Possess Pepper Spray in New York?

New York law generally allows eligible adults age 18 or older to possess qualifying self-defense spray devices when those devices meet applicable state requirements. New York law also restricts possession by individuals with certain felony or assault-related convictions.

Pepper spray may only be used for lawful self-defense. Using a self-defense spray device for any purpose other than lawful self-defense may result in criminal consequences.
